By placing an order, the customer acknowledges having read and understood these Terms before confirming their purchase.

Confirming an order constitutes full and unconditional acceptance of the Terms and Conditions of Sale in effect on the date of the order.

Danae Store reserves the right to amend these Terms. Any changes will apply only to orders placed after the updated Terms have been published.

ARTICLE 1 – PRODUCTS

1.1 Product Characteristics

The essential characteristics of the products offered for sale are provided on their respective product pages.

Danae Store takes great care in presenting, describing and photographing its products.

Product photographs are intended to represent items as accurately as possible. However, slight variations in colour or appearance may occur depending on the screen used, lighting conditions or the specific characteristics of the materials.

Such variations do not entitle Danae Store to deliver a product that does not match the essential characteristics described at the time of purchase.

Any dimensions or measurements provided may vary slightly due to manufacturing processes or measurement methods.

1.2 Product Availability

All products are offered subject to availability.

If a product becomes unavailable after an order has been confirmed, Danae Store will inform the customer as soon as possible.

If the product cannot be supplied, the customer will receive a refund of the amount paid for the unavailable item.

If only certain items in an order are unavailable, the available items may be shipped and the unavailable items refunded, without additional charges to the customer.

ARTICLE 2 – PRICES

All product prices are displayed in euros (€) and include all applicable taxes (VAT included).

Displayed prices do not include delivery charges unless otherwise stated.

Applicable delivery charges are communicated to the customer before the order is finally confirmed.

Danae Store reserves the right to change its prices at any time.

The applicable price is the price displayed when the customer confirms their order.

Once an order has been validly confirmed, its price cannot be changed.

In the event of an obvious pricing error, particularly where a price is clearly disproportionate to the actual value of the product, Danae Store may inform the customer of the error and, where legally permitted, cancel the order and refund any amounts paid.

Promotional codes, special offers and discounts are subject to the specific terms of each promotion.

Unless otherwise stated, multiple promotional offers cannot be combined.

ARTICLE 3 – ORDERS

3.1 Placing an Order

Customers select the products they wish to purchase and add them to their shopping cart.

Before confirming their order, customers can review:

  • Selected products

  • Quantities

  • Prices

  • Applicable discounts

  • Delivery charges

  • Delivery address

  • Billing address

  • Payment method

  • Total order amount

Customers may modify or correct this information before finalising their order.

Customers agree to provide accurate, complete and up-to-date information.

3.2 Order Confirmation

Confirming an order and completing payment constitutes the customer's commitment to pay the indicated amount.

An order confirmation email is then sent to the customer, summarising the main details of their purchase.

Danae Store recommends keeping this confirmation for future reference.

3.3 Refusal or Cancellation of an Order

Danae Store may refuse or cancel an order where there is a legitimate reason, including:

  • Failed or declined payment

  • Reasonable suspicion of fraud

  • Clearly incorrect information

  • Orders containing unusually large quantities for a consumer

  • A dispute concerning payment for a previous order

Consumers retain all rights granted to them under applicable law.

ARTICLE 4 – PAYMENT

Payment is required when the order is confirmed.

Payment methods that may be offered on the website include:

  • Visa

  • Mastercard

  • American Express

  • Apple Pay

  • Danae Store gift cards

The payment methods actually available are displayed during checkout.

Online payments are processed through secure payment solutions integrated into the website, including Shopify Payments.

Banking information required for transactions is processed securely by the relevant payment service providers.

Danae Store does not have access to customers' full payment card numbers.

If payment is declined by the bank or payment service provider, the order may not be confirmed.

ARTICLE 5 – RETENTION OF TITLE

Products remain the property of CHIC & SHOW / Danae Store until full payment has been received.

This retention of title is independent of the legal provisions governing the transfer of risk upon delivery.

6.3 Order Processing

Danae Store processes orders from Monday to Saturday, excluding public holidays.

Orders shipped by a carrier are generally prepared within 24 to 48 hours after payment confirmation, subject to product availability.

Order processing time is additional to the carrier's delivery time.

For Click & Collect orders, Danae Store makes every effort to have orders ready within an estimated four hours, provided the products are available in-store.

This timeframe applies during boutique opening hours.

Orders placed outside opening hours, less than four hours before closing or on a day when the boutique is closed may be processed during the next opening period.

Customers must wait for confirmation that their order is ready before visiting the boutique.

During busy periods, including sales, promotions, holidays or special commercial events, processing times may exceptionally be extended.

6.4 Delivery Times

Danae Store delivers products within the timeframe communicated to the customer when placing the order.

The delivery times indicated for Colissimo and Chronopost are estimated transit times following dispatch.

Where applicable, these times are additional to the order processing period described in Article 6.3.

External circumstances may occasionally affect delivery times.

In the event of delayed delivery, customers retain the rights provided under the applicable provisions of the French Consumer Code.

6.5 Standard Home Delivery via Colissimo

When customers select standard home delivery, their parcel is entrusted to Colissimo and shipped to the address provided at checkout.

Where tracking is available, customers receive the information required to monitor their parcel's delivery.

If the customer is absent at the time of delivery, the carrier may arrange another delivery attempt or make the parcel available at a pickup point in accordance with its delivery procedures.

When a parcel is made available at a pickup point, customers must collect it within the period specified by Colissimo.

If the parcel is not collected within this period, it may be returned to Danae Store.

6.6 Express Home Delivery via Chronopost

When customers select express home delivery, their parcel is entrusted to Chronopost and shipped to the address provided at checkout.

Customers may receive a tracking number or link to monitor their delivery.

If the customer is absent, Chronopost may attempt delivery again or make the parcel available at a pickup point in accordance with its procedures.

The parcel must be collected within the timeframe specified by the carrier.

Otherwise, it may be returned to Danae Store.

6.7 Chronopost Pickup Point Delivery

When customers choose Chronopost pickup point delivery, they select their preferred pickup location from the options available at checkout.

Customers are notified when their parcel is available for collection according to Chronopost's procedures.

Collection may require proof of identity or any other documentation requested by the carrier.

The parcel must be collected within the timeframe specified by Chronopost.

If it is not collected within this period, it may be returned to Danae Store.

If the selected pickup point is closed, full or exceptionally unavailable, Chronopost may redirect the parcel to another nearby pickup point in accordance with its delivery procedures.

6.8 Colissimo Pickup Point Delivery

When customers choose Colissimo pickup point delivery, they select their preferred location from those available at checkout.

Customers are notified when their parcel is ready for collection according to Colissimo's procedures.

The parcel must be collected within the timeframe specified by the carrier.

If the selected pickup point becomes exceptionally unavailable, the parcel may be redirected to another pickup location in accordance with Colissimo's procedures.

If the parcel is not collected within the specified period, it may be returned to Danae Store.

6.9 Click & Collect – In-Store Pickup at Danae Store

When this option is available at checkout, customers may choose to collect their purchases free of charge from the Danae Store boutique.

Click & Collect is a free service.

Subject to product availability in-store, payment confirmation and boutique opening hours, orders are generally prepared and made available for collection within an estimated four hours.

Once an order is ready, the customer receives confirmation by email, SMS or another communication method used by Danae Store.

Customers must wait for this confirmation before visiting the boutique.

Orders placed less than four hours before closing, outside opening hours or on a day when the boutique is closed may be made available during the next opening period.

6.10 Click & Collect Pickup Requirements

When collecting an order, customers may be asked to provide:

  • Order confirmation

  • Order number

  • Valid identification

Orders may also be collected by a third party designated by the customer.

In this case, Danae Store may ask the designated person to present their own identification and the information required to identify the order.

The physical handover of the order to the customer or their designated representative constitutes delivery.

Collecting an order placed and paid for on danaestore.fr does not convert the purchase into an in-store transaction. The rules applicable to distance sales continue to apply where their legal conditions are met.

6.11 Click & Collect Collection Period

From the date the order-ready confirmation is sent, the order will be held in-store for seven calendar days.

Customers may collect their orders during boutique opening hours within this period.

If an order is not collected within this timeframe, it will be automatically cancelled and the items may be returned to stock.

Customers will receive a refund of the amounts actually paid for the order, using the same payment method used for the original purchase.

If an order was paid for fully or partially using a gift card or store credit, the corresponding amount will be credited back to the original payment method.

Refunds will be processed as soon as possible following cancellation.

6.12 Incorrect Address, Unclaimed Parcels or Returns to Sender

Customers are responsible for ensuring that the information provided when placing an order is accurate.

They must check their name, address, postcode, city and any other information required for delivery.

If a parcel is returned to Danae Store due to:

  • An incorrect or incomplete address provided by the customer

  • Failure to collect the parcel within the carrier's specified timeframe

  • Unjustified refusal to accept delivery

  • Any other circumstance directly attributable to the customer

the customer may contact customer service to determine how to proceed with the order.

If reshipment is requested due to circumstances attributable to the customer, additional shipping charges may be payable by the customer.

6.13 Receiving a Parcel

Upon receiving an order delivered to their home or a pickup point, customers are encouraged to inspect the parcel's visible condition.

If the parcel is open, damaged, crushed or shows any visible irregularity, customers are strongly encouraged to report specific concerns to the carrier at the time of delivery whenever possible.

Customers are also encouraged to report any issue to Danae Store as soon as possible at contact@danaestore.fr, providing their order number and, where possible, photographs of the parcel, shipping label, packaging and affected products.

Customers should retain all packaging and received items until their claim has been processed.

Danae Store may request any supporting evidence reasonably necessary to verify the circumstances of delivery and may initiate an investigation with the carrier.

Failure to report concerns to the carrier may make it more difficult to establish the circumstances of any damage or loss.

6.14 Receiving a Click & Collect Order

When collecting an order in-store, customers are encouraged to inspect its visible condition.

Any immediately noticeable issue may be reported to boutique staff before leaving.

This opportunity to inspect the order does not affect the customer's statutory right of withdrawal, where applicable, or any legal guarantees.

6.15 Transfer of Risk

For orders shipped by a carrier, the risk of loss or damage transfers to the customer when they, or a third party designated by them other than the carrier, physically take possession of the products.

For Click & Collect orders, the transfer of risk occurs when the products are physically handed over to the customer or their designated representative.

In the event of a delivery dispute, Danae Store may request relevant supporting evidence and carry out the necessary checks with the carrier to establish the circumstances of delivery.

ARTICLE 7 – RIGHT OF WITHDRAWAL AND RETURNS

7.1 Withdrawal Period

In accordance with Article L.221-18 of the French Consumer Code, consumers have 14 calendar days from receipt of their order to exercise their statutory right of withdrawal, without having to provide a reason.

When several products from the same order are delivered separately, the withdrawal period begins upon receipt of the last relevant product, in accordance with applicable regulations.

7.2 Requesting a Return Through the Danae Store Returns Portal

To make the returns process easier and faster, Danae Store provides an online returns portal, accessible by clicking here or visiting:

https://danaestore.fr/apps/retour

To access their order, customers must enter:

  • Their order number

  • The email address or phone number associated with the order

Customers can then select the relevant order and item(s) and follow the instructions displayed on the portal to submit their return request.

The withdrawal request must be submitted within the statutory 14-day period following receipt of the order.

7.3 Other Ways to Exercise the Right of Withdrawal

Danae Store recommends using the online returns portal to submit return requests.

However, consumers may also exercise their right of withdrawal by submitting any clear and unambiguous statement expressing their decision to withdraw from the purchase before the statutory deadline.

Requests may be sent by email to:

contact@danaestore.fr

Customers may also use the standard withdrawal form provided at the end of these Terms and Conditions of Sale.

Simply returning a product without clearly communicating the decision to withdraw is not sufficient to validly exercise the right of withdrawal.

7.4 Returning Products

After communicating their decision to withdraw, customers have a maximum of 14 days to return the relevant product(s).

Return instructions and the return address are provided as part of the returns procedure.

The direct cost of returning products under the statutory right of withdrawal is borne by the customer, unless Danae Store expressly states otherwise or the return results from an error or lack of conformity attributable to Danae Store.

Customers are advised to use a tracked shipping method and retain proof of postage until the return has been fully processed.

When customers arrange return shipping themselves, they bear the risks associated with transportation until the parcel is received by Danae Store, subject to applicable legal provisions.

7.5 Identifying Returned Parcels

To ensure efficient processing, customers are encouraged to include the information required to identify their order or return inside the parcel whenever requested during the returns procedure.

Parcels returned without sufficient identifying information may require additional processing time.

Danae Store may contact the customer to obtain the information necessary to identify and process the return.

7.6 Condition of Returned Products

Consumers may handle and try on products to the extent necessary to establish their nature, characteristics, size and proper functioning.

Returned products must be complete and, where possible, accompanied by their original accessories, tags and packaging.

In particular, products must not have been:

  • Worn beyond a simple fitting

  • Washed

  • Soiled

  • Deteriorated

  • Damaged

  • Altered

Consumers may be held responsible for any reduction in a product's value resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning.

Danae Store may inspect returned items to determine whether their value has been reduced through use exceeding a simple fitting.

7.7 Incomplete or Damaged Returns

Where a returned product shows clear signs of use, is incomplete, damaged, soiled, washed or has been handled beyond what is necessary for a reasonable fitting, Danae Store may take any resulting reduction in value into account in accordance with applicable regulations.

Each return may be inspected upon receipt.

ARTICLE 8 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for certain products when the conditions established by law are met.

This includes sealed goods that are unsuitable for return for health protection or hygiene reasons and have been unsealed by the consumer after delivery.

Where these legal conditions are met, the following products may be concerned:

  • Certain underwear

  • Certain tights and similar items

  • Certain jewellery, such as earrings or piercings, when supplied in sealed protective packaging designed to guarantee hygiene and subsequently unsealed after delivery

The fact that a product belongs to one of these categories does not, by itself, automatically exclude the right of withdrawal.

Any applicable exclusions may be specified on the product page or during the returns procedure.

ARTICLE 9 – SALE AND PROMOTIONAL ITEMS

Products purchased during sales, promotions, clearance events, "Archives", "Prix Ronds", "Braderie" or any other promotional event remain eligible for the statutory right of withdrawal unless a legal exception applies.

A price reduction does not convert the statutory right to a refund into an entitlement to store credit only.

Danae Store may nevertheless establish specific commercial conditions for exchanges offered in addition to statutory rights, provided these conditions are clearly communicated to customers.

ARTICLE 10 – REFUNDS

When customers validly exercise their right of withdrawal, Danae Store refunds the amounts relating to the returned products.

If the customer returns the entire order, the refund also includes the original delivery charges, up to the cost of the standard delivery method offered when the order was placed.

If the customer selected a delivery method more expensive than the standard option, the additional cost is not refundable.

Refunds are issued without undue delay and no later than 14 days from the date Danae Store is informed of the customer's decision to withdraw.

However, Danae Store may withhold the refund until the returned products have been received or until the customer provides proof of having sent them back, whichever occurs first.

Refunds are made using the same payment method as the original transaction, unless the customer expressly agrees to another method that does not incur additional charges.

For partial returns, the original delivery charges are not refunded if they would have been the same had the customer ordered only the items they kept.

ARTICLE 11 – GIFT CARDS AND STORE CREDIT

When an order has been paid for fully or partially using a gift card or store credit, the corresponding refund amount will be credited back to the original payment method, in accordance with consumers' statutory rights.

If part of the order was paid for by bank card or another monetary payment method, that portion will be refunded in accordance with the rules applicable to the original payment method.

The validity and conditions of use of gift cards and store credit are specified when they are issued or purchased.

ARTICLE 12 – EXCHANGES

Danae Store does not offer exchanges by post.

Customers wishing to change the size, colour or style of an item have two options:

  • Return the relevant product in accordance with the return conditions set out in these Terms and Conditions of Sale, then place a new order on danaestore.fr.

  • Visit the Danae Store boutique to request an exchange directly in-store.

In-store exchanges are subject to availability of the requested product.

Customers must present the relevant product together with proof of purchase.

To qualify for an exchange, products must be in good condition, not worn beyond a simple fitting, not washed or damaged and, where possible, accompanied by their original tags and accessories.

If the requested product is unavailable in-store, customers may return their item in accordance with these Terms and place a new order.

The option to exchange products in-store is an additional commercial service offered by Danae Store and does not limit consumers' statutory rights.

ARTICLE 13 – INCORRECT, DAMAGED OR NON-CONFORMING PRODUCTS

If a customer receives an incorrect, defective, damaged, incomplete or non-conforming product, they are encouraged to contact Danae Store customer service as soon as possible, ideally within 48 hours of receipt.

Requests should be sent to:

contact@danaestore.fr

To help process the request efficiently, customers are encouraged to provide:

  • Their order number

  • The reference of the affected product

  • A detailed description of the issue

  • Photographs showing the issue, where relevant

Danae Store may request additional information or supporting evidence reasonably necessary to assess the claim.

After reviewing the situation, the appropriate solution will be determined in accordance with the customer's statutory rights and applicable legal guarantees.

Where a return is necessary due to an error or lack of conformity attributable to Danae Store, the customer will not bear the costs necessary to bring the product into conformity.

The suggested 48-hour reporting period is intended to facilitate the prompt handling of claims and does not limit consumers' statutory legal guarantees.

ARTICLE 14 – STATUTORY WARRANTIES

Independently of the right of withdrawal, products sold on danaestore.fr benefit from the statutory warranties provided under applicable law.

Terms and Conditions of Sale applicable to goods must inform consumers of the existence, scope and conditions for exercising the statutory guarantee of conformity and the warranty against hidden defects. They must also include the information box required by Article D.211-2 of the French Consumer Code.

14.1 Statutory Guarantee of Conformity

Consumers have two years from delivery of the goods to benefit from the statutory guarantee of conformity if a lack of conformity becomes apparent.

Under the conditions established by law, this guarantee entitles consumers to repair or replacement of the goods, free of charge and without significant inconvenience.

Repair or replacement must, in principle, be completed within a maximum of 30 days following the request.

In circumstances provided for by law, particularly where bringing the product into conformity is impossible, refused, excessively delayed or where the defect persists, consumers may be entitled to a price reduction or termination of the sale.

When a product is repaired under the statutory guarantee of conformity, the original guarantee is extended by six months under the conditions established by applicable regulations.

14.2 Warranty Against Hidden Defects

Consumers also benefit from the warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

This warranty applies where a hidden defect makes the product unsuitable for its intended use or significantly reduces its usefulness to the extent that the customer would not have purchased it, or would have paid a lower price, had they known about the defect.

Claims must be brought within the applicable statutory period following discovery of the defect.

Where the conditions of this warranty are met, consumers may keep the product and obtain a price reduction or return it and receive the corresponding refund.

14.3 Exercising Statutory Warranties

The business responsible for these warranties is:

CHIC & SHOW / Danae Store 31 boulevard du Jeu de Paume 34000 Montpellier France

Email: contact@danaestore.fr Phone: +33 9 83 41 57 46

To facilitate the handling of requests, customers are encouraged to provide:

  • Their order number

  • The reference of the affected product

  • A description of the issue

  • Photographs of the product, where useful

Exercising statutory warranties must not result in costs being charged to consumers where the legal conditions are met.

ARTICLE 15 – LIABILITY

Danae Store is responsible for the proper performance of its contractual obligations in accordance with applicable regulations.

However, Danae Store cannot be held liable where non-performance or improper performance results from:

  • A fault attributable to the customer

  • An event of force majeure meeting the conditions established by law

  • An external cause that legally exempts the seller from liability

A disruption, strike or incident affecting a carrier does not automatically constitute an event of force majeure.

Nothing in these Terms and Conditions of Sale may exclude or limit any mandatory rights granted to consumers.

ARTICLE 16 – PERSONAL DATA

Personal data provided by customers is processed in particular for:

  • Order management

  • Payment processing

  • Delivery

  • Invoicing

  • After-sales service

  • Returns management

  • Customer relations

Detailed information regarding data processing activities, their legal bases, retention periods and the rights of individuals is provided in the Privacy Policy available on danaestore.fr.

Payment-related data may also be processed by the payment service providers used by Danae Store.

All elements of danaestore.fr, including text, photographs, images, illustrations, logos, graphics and distinctive signs, are protected by applicable intellectual property laws.

Any unauthorised reproduction, representation, adaptation or use of all or part of these elements is prohibited, subject to exceptions provided by law.

To facilitate the handling of their complaint, customers are encouraged to provide:

  • Their order number

  • The nature of their complaint

  • Any relevant information required to assess their request

  • Photographs or supporting documents, where necessary

Danae Store makes every effort to handle complaints promptly and seek an amicable resolution with customers.

ARTICLE 20 – GOVERNING LAW AND JURISDICTION

These Terms and Conditions of Sale are governed by French law.

CHIC & SHOW / Danae Store is established in Montpellier (34000), France.

In the event of a dispute, and after pursuing the amicable resolution procedures described in Article 19 where applicable, the matter may be brought before the competent courts in accordance with applicable legal provisions.

Nothing in these Terms and Conditions of Sale may deprive consumers of the mandatory rights and protections granted to them under applicable law.

ARTICLE 21 – AMENDMENTS AND VALIDITY OF THE TERMS AND CONDITIONS OF SALE

Danae Store reserves the right to amend these Terms and Conditions of Sale at any time, particularly to reflect legislative, regulatory, technical or commercial developments.

Changes to these Terms do not apply to orders already concluded before the amendments take effect.

The version applicable to an order is the version in force and accepted by the customer when the order is confirmed.

If any provision of these Terms and Conditions of Sale is declared invalid, unlawful or unenforceable, the remaining provisions will remain fully effective.
